This thesis examines Canada’s criminal legislation on prostitution and brings to light its harmful and contradictory qualities. By taking an analytical approach, an argument for decriminalization is made which calls for the repeal of all the legislation relating to prostitution. The argument is given further context through the debate between feminists and prostitutes over the controversial nature of the profession and whether the government should be allowed to legislate on an issue that creates a clear moral division. This thesis also looks at society’s openness to the public display of sex and determines the extent to which sex is already commodified within various entertainment mediums.
